Welcome to Schooligio.ai (the “Platform”), an AI-powered educational tool provided by Schooligio AI LLC (the “Company,” “we,” “us,” or “our”). These Terms and Conditions (“Terms”) govern your access to and use of the Platform, including any content, features, or services offered through it. By accessing or using the Platform, you agree to be bound by these Terms. If you are accessing the Platform on behalf of a school, district, or organization (“Educational Institution”), you represent that you have the authority to bind that entity.

Please read these Terms carefully. If you do not agree, do not use the Platform. We may update these Terms from time to time, and we will provide at least 30 days’ notice of material changes via email or in-app notification. Your continued use after the effective date of changes constitutes acceptance.

1. Eligibility and Account Registration

  • Age Requirements: You must be at least 13 years old to create an account or use the Platform independently. Users under 18 must obtain verifiable consent from a parent or legal guardian. For users under 13, access is prohibited unless facilitated through an Educational Institution that obtains and documents verifiable parental consent in compliance with the Children’s Online Privacy Protection Act (COPPA), as amended effective June 23, 2025. Educational Institutions are responsible for verifying and maintaining consent records, including opt-in mechanisms for any data collection or sharing.
  • Account Creation: To use certain features, you must register an account with accurate information. You are responsible for maintaining the confidentiality of your login credentials and for all activities under your account.
  • Educational Institution Users: If you are an Educational Institution, you must ensure compliance with all applicable laws, including obtaining consents and providing us with documentation upon request.

2. Description of Services

Schooligio.ai provides AI-driven tools for educational counseling, personalized learning recommendations, and student progress tracking. Features may include chat interfaces, data analysis, and content generation. All AI outputs are for informational purposes only and should be verified by qualified educators or professionals.

3. User Responsibilities

  • Compliance with Laws: You agree to use the Platform in compliance with all applicable laws, including but not limited to FERPA (Family Educational Rights and Privacy Act), COPPA (as updated by FTC amendments effective 2025, including strengthened opt-in consents and data security), GDPR (General Data Protection Regulation), CCPA/CPRA (California Consumer Privacy Act/California Privacy Rights Act), SOPIPA (Student Online Personal Information Protection Act and equivalent state laws in CA, NY, FL, and others), PPRA (Protection of Pupil Rights Amendment), the EU AI Act (for high-risk educational AI systems, requiring transparency and bias mitigation), and NIST AI Risk Management Framework principles (for managing AI risks like bias and privacy harms).
  • Consents and Data Handling: Educational Institutions must obtain and document all necessary consents (e.g., parental opt-in for under-13 users per COPPA) and ensure data is used only for educational purposes. You must not input sensitive data without consent or use the Platform for non-educational purposes.
  • Prohibited Conduct: You may not: (a) misuse the Platform for commercial gain, advertising, or profiling; (b) input harmful, illegal, or biased content; (c) reverse-engineer AI models; or (d) violate intellectual property rights.
  • Accessibility: We strive to comply with the Americans with Disabilities Act (ADA), Section 504 of the Rehabilitation Act, and Web Content Accessibility Guidelines (WCAG) 2.1 Level AA to ensure the Platform is accessible to users with disabilities. Report any issues to support@schooligio.ai.

4. AI-Specific Disclaimers

  • AI-generated content may contain inaccuracies, biases, or hallucinations. It is not a substitute for professional advice. We implement measures aligned with the EU AI Act and NIST AI RMF, including regular bias audits, human oversight for high-risk decisions, and transparency in AI training data sources (anonymized and de-identified where possible).
  • Users must verify all outputs. We are not liable for decisions based on AI recommendations.

5. Intellectual Property and Licenses

  • Our Rights: The Platform, including AI models and content, is owned by us or our licensors. We grant you a limited, non-exclusive, revocable license to use it for educational purposes.
  • User Content: You retain ownership of content you upload (e.g., student data belongs to the Educational Institution or individual). You grant us a license to use it to provide and improve services, subject to our Privacy Policy.

6. Data Privacy and Security

Please review our Privacy Policy (incorporated herein) for details on data handling. We commit to:

  • Using reasonable security measures, including AES-256 encryption for data at rest and in transit, access controls, regular vulnerability assessments, and penetration testing.
  • Notifying users of data breaches within legally required timelines (e.g., 72 hours under GDPR).
  • Requiring data processing agreements (DPAs) with third-party vendors to ensure compliance.

7. Termination and Suspension

We may terminate or suspend your access for violations of these Terms, with notice where feasible. Upon termination, data will be handled per the Privacy Policy (e.g., export and deletion options for Educational Institutions).

8. Disclaimer of Warranties

The Platform is provided “as is” without warranties of any kind. We disclaim all implied warranties, including merchantability or fitness for a particular purpose.

9. Limitation of Liability

To the fullest extent permitted by law, our liability is limited to the fees paid by you in the preceding 12 months. We are not liable for indirect, consequential, or punitive damages. This limitation does not apply to gross negligence or willful misconduct.

10. Indemnification

You agree to indemnify us against claims arising from your use of the Platform, including violations of laws or third-party rights.

11. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of California, USA, without regard to conflict of laws principles. Disputes shall be resolved through binding arbitration in San Francisco, CA, under the rules of the American Arbitration Association, except for small claims or injunctive relief.

12. Miscellaneous

  • Data Ownership and Export: Educational Institutions own student data. Upon request or contract end, we will export data in a standard format and delete it within 30 days.
  • Changes: We provide 30 days’ notice for material changes.
